3 accused of Gujarat police acquitted in Ishrat Jahan encounter case

Gandhinagar| A special court of the Central Bureau of Investigation (CBI) on Wednesday accused 3 accused officers of the Gujarat Police – GL Singhal, Tarun Barot and A.R. in the Ishrat Jahan encounter case. Chaudhary was acquitted and the proceedings against him were also canceled. Special CBI Judge Vipul Rawal on Wednesday allowed the discharge application introduced by the three police officers of Gujarat and charged them with offenses under sections 341, 342, 343, 365, 368, 302 and 201 of the IPC and sections of the Indian Arms Act. Acquitted of offenses under 25 (1) (e) and 27. He was released on a personal bond of Rs 15,000.

Three accused police officers – IPS officer GL Singhal, retired deputy SP Tarun Barot and assistant sub-inspector A.B. After being denied the sanction to prosecute Chaudhary, the special CBI court quashed the proceedings against him and acquitted him of the case.

The three policemen were charged with murder, criminal conspiracy, kidnapping and illegal detention of Mumbra’s 19-year-old girl.

Ishrat Jahan and his companions Javed Sheikh alias Pranesh Pillai, Zeeshan Johar and Amjad Ali Rana were killed in a police encounter on June 15, 2004, on the outskirts of Ahmedabad.

CBI lawyer R.C. Kodekar on Wednesday argued that the plea by the Gujarat government which refused to allow the prosecution of the accused was not prudent. Therefore the application should be rejected.

The CBI court believed the Gujarat police story stating that “they had received information from the Intelligence Bureau (IB) that four terrorists had entered Gujarat and in retaliation the police killed them all, hence the police The officers carried out this action while performing their duties. ”

The court also said that in the present case, the CBI has not filed any application for sanction for prosecution. The CBI should be cleared for prosecution when it is established that the accused have taken action while performing their official duties.

Significantly, seven policemen were prosecuted in a session court in the Ishrat Jahan encounter case. An accused and complainant J.G. Parmar died during the trial of the case. By the time the CBI filed the charge sheet in the case, the commando Mohan Kalaswa also died
