New Delhi. The Supreme Court has dismissed BRS leader K., arrested by the Enforcement Directorate (ED) in the Delhi Excise Policy case. Refused to give any interim relief to Kavita on Friday. He had challenged his arrest in the apex court.
A special bench headed by Justice Sanjiv Khanna said the statutory process cannot be bypassed for a political person or a person who can directly file a petition in the apex court. The apex court asked senior advocate Kapil Sibal, appearing for Kavita, to approach the lower court for bail. The bench comprised Justice M.M. Sundaresh and Bela M. Trivedi were also present.
The special bench issued notice to the ED on a plea by Kavita and directed to tag her plea with other pending petitions. The petition challenges the provisions of the Prevention of Money Laundering Act (PMLA).
The apex court on Tuesday allowed withdrawal of the petition filed by the BRS leader against the ED summons as it had become infructuous following his arrest by the central agency on March 15.
Granting interim relief to Kavita, the Supreme Court had in September last year asked the ED not to insist on her presence till the next date of hearing in the ongoing investigation against the now-canceled liquor policy of the AAP-led Delhi government. Later this interim protection was extended till 13 March.
Kavitha, daughter of BRS supremo and former Telangana Chief Minister K. Chandrashekhar Rao, was arrested from Hyderabad on March 15 and brought to Delhi. A Delhi court had sent him to ED custody.
