New Delhi| The Delhi High Court on Tuesday granted bail to Natasha Narwal, Devangana Kalita and Asif Iqbal Tanha in the Delhi violence case under the Unlawful Activities (Prevention) Act.
Justice Siddharth Mridul and Justice Anoop J. Bhambhani observed that prima facie, no offense under Section 15, 17, or 18 of UAPA is made out against the three on the basis of material recorded in the present case. Taking into account several facts, the court held that protest is not terrorist activity.
The court said the bail to the trio is subject to a personal bond of Rs 50,000 and two local sureties. Apart from this, the conditions included as surety are that all three will have to submit their passports and not indulge in any such activities which may hamper the case.
Tanha is a graduate student from Jamia Millia Islamia. He was arrested in May 2020 in connection with the Delhi violence under the UAPA and has been in continuous custody since then. Narwal and Kalita are Ph.D. scholars at Jawaharlal Nehru University, associated with the Pinjra Tod movement. They are in custody since May 2020.
The case pertains to the investigation by the Delhi Police into an alleged conspiracy that led to the horrific violence in Delhi in February 2020. According to the police, the three accused along with other accused conspired to create such disturbance on an unprecedented scale so as to disturb the law and order situation.
