The internment of pregnant Safoora Zargar a student activist and impertinence of court for refusing her bail has raised many questions on Indian Judiciary System. It has led to doubt even that “Indian Judiciary System is still independent”?

Safoora Zargar biography? Marriage and Husband name?

Safoora Zargar biography: She is a 27 years old research student (Sociology) at Jamia Millia Islamia,Delhi. She got married to Saboor Ahmed. She was arrested on 10th April on charges of restraining roads and hindering traffic. After getting bail in that case she was re-arrested on 13th April under the remorseless provision of the Unlawful Activities (Prevention) Act, 1967. She was placed in judicial custody after she was snarled in a conspiracy of violence in Delhi in the month of February.

The Right to protest peacefully is enshrined in the Indian Constitution

  • Article 19(1)(b) assures citizens the right to assemble peaceably and without arms.
  • Article 19(2) imposes reasonable restrictions on the right to assemble peaceably and without arms.
  • These reasonable restrictions are imposed in the interests of the sovereignty and integrity of India, the security of the State, friendly relations with foreign States, public order, decency or morality or in relation to contempt of court, defamation or incitement to an offence.

In Ramlila Maidan Incident vs. Home Secretary, Union Of India & Ors. case (2012), the Supreme Court had stated, “Citizens have a fundamental right to assembly and peaceful protest which cannot be taken away by an arbitrary executive or legislative action.”

Safoora was pregnant at the time of her arrest.

Well it is pointless to raise question on arrest of pregnant women married to Saboor Ahmed Sirwal because there is no any provision in law that restrains the arrest of a pregnant women rather there are instructions for taking care of pregnant women in jail. But the question arise in case of Safoora Zargar is how she has been falsely charged for the crime she never committed inspite of her pregnancy and amid the coronavirus pandemic the activists and lawyers all over the nation started to raise their voices for Safoora’s release on humanitarian ground.

It has seen that police have used draconian provisions of Unlawful Activities (Prevention) Act,1967 against students, activists,lawyers but not acted against violence by supporter of the ruling party.

Even Kapil Mishra who led the riot by giving an incendiary speech on 23rd February is roaming freely.

Well everyone has witnessed the brutality led by the police during CAA protest. It has unveiled the dictatorship of political party over the indian police.

Mark Zuckerberg targetted Kapil Mishra’s threat 

Things doesn’t stopped here. This riot garnered attention of other countries as well. It was seen many gulf countries came forward in support of the CAA protestors. Even facebook’s CEO Mark Zuckerberg used Kapil Mishra’s threat to contour facebook’s hate speech policy.
“And there have been cases in India, for example, where someone said, ‘Hey, if the police don’t take care of this, our supporters will get in there and clear the streets’,” Zuckerberg said.

Finally Safoora Zargar got bail

Safoora Zargar got bail during her pregnancy on Tuesday on humanitarian ground and asked not to leave the state without permission.

“We are thankful to the courts. I also thank our lawyers for their efforts. The family is eagerly looking forward to meet her,” her husband Saboor Ahmed Sirwal said.

Mr Mehta had argued that Safoora Zargar should not be granted bail as “the severity of her offence is in no manner mitigated by the fact of her pregnancy.”

Other activists are also charged under draconian provisions of Unlawful Activities (Prevention) Act 1967. Asif Tanha, Sharjeel Imam, Umar Khalid and other anti-CAA campaigners.

Well Judiciary System plays a vital role in making a country democratic. Now it is to see how Indian Judiciary System saves democracy of India.
