NEW DELHI: Those who were unable to register their vehicles before the March 31 deadline due to the nationwide bandh, have received huge relief from the Supreme Court. The Supreme Court has allowed registration of BS-4 vehicles sold till 31 March. A bench headed by Justice Arun Mishra said that all registrations are allowed on the e-portal, including temporary registration. However, the exemption will not apply for Delhi-NCR.
The apex court said, “We cannot allow registration of vehicles in Delhi-NCR. This is not applicable for Delhi NCR.”
The apex court said that only those BS-IV vehicles that were sold before the nationwide shutdown would be registered and the vehicle uploaded on the e-portal. That is, the ban on registration of BS-4 vehicles sold after the nationwide shutdown will continue. The court said that BS-4 vehicles sold after 31 March will not be registered.
The apex court barred the registration of some such vehicles, which were sold by dealers during the period of nationwide shutdown.
Senior advocate K. K., appearing on behalf of the Federation of Automobile Dealers Association (FADA). V. Vishwanathan said, “We will comply with whatever the court says. But I urge you to reject any idea that the closed period has been misused or misused.”
Additional Solicitor General Aishwarya Bhati, representing the Center, argued before the bench that details of 39,000 vehicles have not been uploaded.
“Apart from this, the rest has been traced and details are available on the e-vehicle portal,” he said.
The apex court did not allow registration of 39,000 vehicles that have not been uploaded on e-vehicles.
Explain that the Supreme Court had fixed the deadline of 31 March 2020 for the sale and registration of BS-4 vehicles. Meanwhile, there was a Janata curfew on 22 March and a nationwide bandh came into force from 25 March. At the same time, dealers had a large number of BS-4 two-wheeler and four-wheeler vehicles for sale. Therefore, the dealers reached the Supreme Court, seeking to extend the deadline for the sale and registration of these vehicles.
